Terms of service
Welcome to EssentialTag.
These Terms & Conditions explain the terms that apply when you access our website, use our services or purchase products from EssentialTag.
Please read these Terms & Conditions carefully before placing an order.
By using our website or placing an order with us, you agree to these Terms & Conditions together with our Privacy Policy, Returns & Refunds Policy and any other policies referred to on our website.
Nothing in these Terms affects your statutory rights as a consumer.
1. About EssentialTag
EssentialTag is an independent UK sportswear reseller offering carefully selected new and pre-owned clothing and related products.
Our contact details are:
EssentialTag
Suite A
82 James Carter Road
Mildenhall
IP28 7DE
United Kingdom
Email: essentialtag@gmail.com
Please note that the above is our business/contact address and is not necessarily the address to which returns should be sent.
If you wish to make a return, please contact us first. The appropriate return address and return instructions will be provided once your return has been arranged.
EssentialTag is an independent reseller and is not affiliated with, sponsored by, endorsed by or an authorised retailer of Adidas or any other third-party brand featured on our website unless expressly stated otherwise.
All third-party brand names, trademarks and logos remain the property of their respective owners.
2. Our Website
Our ecommerce services are powered in part by Shopify.
Shopify provides technology that allows us to operate our online store, shopping cart and checkout.
Any purchase you make from EssentialTag is a transaction between you and EssentialTag. Shopify is not the seller of products offered by EssentialTag.
We may update, modify, suspend or withdraw parts of our website from time to time.
We do not guarantee that our website will always be available without interruption.
3. Our Products
We aim to provide accurate descriptions, photographs and information for all products listed on our website.
Product information may include:
- product name
- brand
- size
- colour
- condition
- measurements
- style or product codes
- materials
- photographs
- other relevant information
Please review the product page carefully before placing your order.
New and pre-owned items
EssentialTag may sell both new and pre-owned products.
Where a product is pre-owned, reasonable signs of previous wear may be present.
We aim to identify and photograph notable signs of wear, marks, defects or other relevant characteristics where applicable.
The age, price, description and disclosed condition of a pre-owned product should therefore be taken into account when assessing its condition.
Your statutory consumer rights still apply to pre-owned products.
Product photographs
We make reasonable efforts to represent our products accurately.
However, colours and appearance may vary slightly depending on:
- your device
- screen settings
- lighting
- photography
- display calibration
Small differences between the appearance of a product on your screen and its appearance in person do not necessarily mean the product is defective or incorrectly described.
4. Authenticity
EssentialTag is committed to selling authentic products.
We assess the products we offer before listing them for sale using the information and evidence reasonably available to us.
If you have concerns regarding the authenticity of a product purchased from EssentialTag, please contact us at:
Please include your order number and details of your concern so that we can investigate.
Nothing in this section limits your statutory rights where goods are not as described or otherwise fail to meet applicable consumer law requirements.
5. Product Availability
Much of the stock sold by EssentialTag is available in limited quantities.
Some products may be individual or one-off pieces with a quantity of only one available.
Adding an item to your basket does not reserve that item.
A product is not guaranteed to remain available until your order has been successfully completed and accepted.
In the unlikely event that a product becomes unavailable after you place an order, we will contact you and refund any amount you have paid for the unavailable product.
6. Prices
All prices displayed on our website are shown in pounds sterling (GBP) unless otherwise stated.
The price charged will normally be the price displayed at the time you place your order.
Delivery charges, where applicable, will be shown separately before you complete checkout.
We may change product prices at any time.
Any price change will not normally affect an order that has already been accepted.
Pricing errors
Although we make reasonable efforts to ensure our prices are accurate, mistakes may occasionally occur.
If an obvious pricing error affects an order you have placed, we may contact you before accepting or fulfilling the order.
You may then be given the opportunity to purchase the product at the correct price or cancel the affected item.
If we cancel an order for which payment has already been taken, the relevant amount will be refunded.
7. Placing an Order
When you place an order through our website, you are making an offer to purchase the products in your order.
You are responsible for checking your order before submitting it, including:
- products
- sizes
- quantities
- delivery address
- contact information
- payment information
After placing an order, you may receive an automated confirmation email.
An automated acknowledgement does not necessarily mean that your order has been accepted.
A contract for the sale of goods is formed when we accept your order in accordance with our checkout and fulfilment process.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- an item is unavailable
- there has been an obvious pricing or description error
- payment cannot be authorised
- the delivery information provided is incomplete or invalid
- we reasonably suspect fraud or misuse
- we are otherwise unable to fulfil the order
If we cancel an order after taking payment, we will refund the appropriate amount.
8. Payment
Payment is processed securely through Shopify and supported third-party payment providers.
The payment methods currently available will be displayed during checkout.
We do not directly store your complete payment card details.
You must ensure that:
- payment information is accurate
- you are authorised to use the selected payment method
- the billing information you provide is correct
Your order may not be processed if your payment cannot be authorised.
9. Delivery
Available delivery methods, costs and estimated delivery times will be displayed during checkout or explained in our Shipping Policy.
We aim to dispatch orders within the timeframe stated on our website.
Delivery dates and transit times are estimates unless we expressly agree otherwise.
Under UK distance-selling rules, goods generally need to be delivered within 30 days unless a different delivery period has been agreed with the customer.
We are not responsible for delays caused by circumstances outside our reasonable control, although we will take reasonable steps to assist where appropriate.
Risk during delivery
Where we arrange delivery using one of the delivery methods offered by us, responsibility for the goods generally remains with us until the goods come into your physical possession, or the possession of a person you have identified to receive them.
An exception can apply if you independently arrange your own carrier that we did not offer as a delivery option.
This replaces the original Shopify template wording that stated risk passed when the product was transferred to the carrier.
10. Returns
We offer a 30-day returns policy.
Our full Returns & Refunds Policy explains:
- how to request a return
- return eligibility
- return postage
- damaged or incorrect products
- refunds
- statutory cancellation rights
To request a return, contact:
Please include your order number and details of the product you wish to return.
Once your return has been arranged, we will provide you with:
- the appropriate return address
- return instructions
- any other information needed to process the return
Please do not send a return to our published business address unless we have specifically instructed you to do so.
Sending an item to an address other than the return address provided to you may delay the processing of your return.
Our voluntary 30-day return policy does not affect your statutory consumer rights.
11. Your Right to Cancel an Online Order
For most products purchased online, UK consumers have a statutory right to cancel their purchase without giving a reason.
Generally, you must tell us that you wish to cancel within 14 days after receiving the goods.
After notifying us that you wish to cancel, you generally have a further 14 days to return the goods.
You may notify us by contacting:
You may use the cancellation form at the end of these Terms, but you do not have to use it. Any clear statement informing us of your decision to cancel is sufficient where the statutory cancellation right applies.
Certain products or circumstances may be excluded from statutory cancellation rights under applicable law.
Our 30-day returns policy provides additional time beyond the statutory cancellation period, subject to the conditions set out in our Returns & Refunds Policy.
12. Handling Returned Products
When exercising statutory cancellation rights, you may inspect a product in a manner similar to how you would reasonably inspect it in a physical shop.
You should take reasonable care of products while they are in your possession.
Where your handling goes beyond what is reasonably necessary to establish the nature, characteristics and functioning of the product and this reduces its value, we may be entitled to make an appropriate deduction from your refund.
For our additional voluntary 30-day returns policy, further eligibility conditions may apply as explained in our Returns & Refunds Policy.
13. Return Postage
For change-of-mind returns under our voluntary returns policy, the customer is responsible for return postage unless we state otherwise.
For statutory cancellations, responsibility for return costs will be handled in accordance with applicable consumer law and the information provided to you before purchase.
If a product is faulty, damaged, incorrectly described or we have sent you the wrong item, please contact us before returning it.
Where required, we will arrange or reimburse appropriate return costs.
We recommend that customers obtain proof of postage and use a tracked return service where appropriate.
14. Refunds
Refunds will normally be made to the original payment method.
Where statutory cancellation rights apply, refunds will be processed within the timeframe required by applicable law.
For online cancellation rights, UK guidance generally requires the trader to refund the customer within 14 days of receiving the returned goods. Traders may also be required to refund the basic outbound delivery cost where applicable.
Our Returns & Refunds Policy contains further information about refund processing.
The time taken for a refund to appear after we issue it may depend on your bank, card provider or payment service.
15. Faulty, Damaged or Incorrect Products
Please inspect your order after delivery.
If a product is:
- faulty
- damaged
- not as described
- incorrect
- different from the item you ordered
please contact us as soon as possible at:
Include your order number and, where helpful, photographs of the issue.
UK consumers are entitled to legal remedies where goods are faulty, not as described or do not do what they are supposed to do.
Nothing in these Terms limits those rights.
16. Exchanges
We do not currently offer direct exchanges unless otherwise stated.
If you would like a different product or size, you may return the eligible product in accordance with our Returns & Refunds Policy and place a separate order.
Because many of our products are available in limited quantities, we cannot guarantee that an alternative size or product will remain available.
17. Sale and Discounted Products
Products purchased during a sale or promotion remain subject to any statutory consumer rights that apply.
A discounted price does not remove a customer's legal rights where goods are faulty or where statutory cancellation rights apply. UK government guidance states that sale goods have the same statutory refund rights as full-price goods.
Any additional voluntary promotion-specific terms will be made clear where applicable.
18. Promotions and Discount Codes
We may occasionally offer:
- promotional codes
- discounts
- reduced prices
- delivery promotions
- limited-time offers
Promotions may be subject to additional conditions.
Unless otherwise stated:
- promotional codes cannot be exchanged for cash
- promotional codes may have an expiry date
- some products may be excluded
- promotions may not be combined
We may withdraw or amend a promotion where reasonably necessary, provided this does not unlawfully affect an order that has already been accepted.
19. Product Reviews, Feedback and Content
If you choose to submit a product review, photograph, feedback or other content to EssentialTag, you confirm that you have the right to submit that content.
Content must not:
- infringe another person's intellectual property rights
- contain unlawful material
- contain malicious software
- be fraudulent or misleading
- unlawfully disclose another person's personal information
We may moderate or remove content where reasonably necessary.
If you give us permission to use submitted content for marketing or promotional purposes, any such use will be subject to applicable law and the permission you have provided.
20. Intellectual Property
The EssentialTag name, branding, original website design, written material and other original content produced for EssentialTag are owned by us or used with permission.
You may use our website for your own personal and lawful purposes.
Unless permitted by law, you must not reproduce, distribute, commercially exploit or substantially copy our original website content without permission.
Third-party brand names, logos and trademarks appearing on products or elsewhere on our website remain the property of their respective owners.
The sale of branded products through EssentialTag does not imply that the relevant brand sponsors, endorses or is affiliated with EssentialTag.
21. Acceptable Use
You must not knowingly use our website:
- for unlawful purposes
- fraudulently
- to introduce malware or harmful software
- to interfere with our website or systems
- to gain unauthorised access to systems or data
- to misuse promotions or checkout functionality
- to infringe the rights of other people
- to impersonate another person
- to submit deliberately false or misleading information
We may restrict or block access where reasonably necessary to protect our customers, business or systems.
22. Third-Party Services and Links
Our website may use services provided by third parties, including:
- Shopify
- payment providers
- delivery providers
- analytics providers
- other ecommerce service providers
Our website may also contain links to third-party websites.
We are not responsible for the content, availability or practices of websites that we do not control.
Third-party services may be subject to their own terms and privacy policies.
23. Shopify
EssentialTag uses Shopify technology to provide parts of our online store and ecommerce services.
However, products purchased through EssentialTag are sold directly by EssentialTag.
Questions regarding:
- products
- orders
- refunds
- returns
- delivery
- authenticity
- customer service
should therefore be directed to EssentialTag rather than Shopify.
This section retains the substance of the Shopify relationship provision included in the original template.
24. Privacy
We process personal information in accordance with our Privacy Policy.
Information may be processed by Shopify and other service providers where necessary to:
- operate our website
- process payments
- fulfil orders
- provide customer service
- prevent fraud
- provide other ecommerce functionality
Please read our Privacy Policy for more information.
Shopify's own privacy policy may also apply to personal information processed directly by Shopify.
25. Cookies
Our website may use cookies and similar technologies.
Where required, we will request consent for non-essential cookies.
Further information about the cookies and technologies used on our website can be found in our Cookie Policy or privacy settings.
26. Errors and Inaccuracies
Occasionally, our website may contain errors or omissions relating to matters such as:
- product information
- availability
- descriptions
- pricing
- promotions
- delivery information
We may correct such errors when discovered.
Where an error affects an order, we will handle the situation fairly and in accordance with applicable law.
27. Our Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits your statutory consumer rights.
We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill where applicable.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed, except where the law provides otherwise.
Where you purchase products as a consumer, we are not responsible for losses arising solely from business or commercial use that were not reasonably contemplated by the consumer contract, to the extent permitted by law.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.
28. Events Outside Our Reasonable Control
We will not be responsible for delays or failure to perform obligations caused by circumstances outside our reasonable control.
Examples may include:
- severe weather
- transport disruption
- postal or carrier disruption
- network outages
- industrial action
- natural disasters
- government action
If such an event affects an order, we will take reasonable steps to minimise its impact and communicate with you where appropriate.
Your statutory rights remain unaffected.
29. Changes to These Terms
We may update these Terms & Conditions from time to time.
Changes may be made to reflect:
- changes to our business
- changes to our website
- changes to Shopify or payment systems
- changes to delivery arrangements
- changes in applicable law
The Terms applicable to an order will generally be those in effect when the order was placed.
The latest version will be available on our website.
30. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
31. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
32. Governing Law
These Terms and contracts between EssentialTag and customers are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you based on where you live.
If you are a consumer resident elsewhere in the United Kingdom, nothing in these Terms removes any mandatory rights you have under the laws applicable to you or your right to bring proceedings in an appropriate court.
